These Terms govern your use of the Pretty Serious Baseball mobile
game and its online service (the "Game"). By creating an account or
playing, you agree to these Terms and to our Privacy Policy (https://prettyseriousbaseball.com/privacy).
If you do not agree, do not use the Game.
1. Eligibility and accounts
The Game is an online service and requires an account and an
internet connection.
The Game is not directed at children under 13 (or the higher age of
digital consent in your country, e.g. 14 in the Republic of Korea). If
you are a minor above that age, you confirm that a parent or guardian
has reviewed these Terms and consents to your play and to any
purchases.
You may register with an email address and password or with a
supported identity provider (Google; Apple where available). Your Game
ID is permanent. You are responsible for keeping your credentials and
device secure and for all activity under your account. Do not share
accounts.
One person may not operate multiple accounts to gain an advantage
(for example to farm referral rewards or manipulate the market). We may
merge, suspend or close such accounts.
You may sign out at any time in the Game. Resetting your password
signs out every device.
2. Licence
We grant you a personal, limited, non-exclusive, non-transferable,
revocable licence to install and play the Game on a compatible device
for your own entertainment. All content — characters, art, names, story,
music, software, and the Game's server data — belongs to us or our
licensors. You may not copy, modify, reverse-engineer, decompile,
automate, scrape, or interfere with the Game or its servers, or use
cheats, bots, modified clients or exploits.
3. Virtual currency and items
The Game has two currencies: Coins (earned by play)
and Blue Diamonds (earned by play or bought through
Google Play). It also has virtual items: player cards, equipment,
materials, costumes, emoticons, cheer items and reward boxes ("Virtual
Items").
Virtual currency and Virtual Items are not real money, have
no monetary value outside the Game, and cannot be exchanged for money,
transferred outside the Game, or sold to other players for real
money. In-game trading between players (the FA market and
equipment listings) uses in-game currency only and is subject to the
Game's rules and fees.
What you buy is a limited licence to use the Virtual Items inside
the Game while your account is in good standing. You do not own
them.
We may add, change, rebalance, expire or remove Virtual Items and
features. Seasonal or time-limited items expire as stated in-game.
Enhancement, market listings, salvage and similar actions consume items
as described in-game and are final once confirmed.
Virtual Items are delivered to your account only after our server
verifies the purchase with Google Play. If a purchase cannot be
verified, it is not delivered.
4. Purchases and refunds
Purchases are made through Google Play under Google's terms and
refund rules. Prices are shown in the store before you confirm. Google
is the merchant of record; we do not receive your payment details.
All purchases of Blue Diamonds and Virtual Items are final
and non-refundable except where required by applicable law or by Google
Play's refund policy. Where a refund is granted for a purchase
already consumed (for example, diamonds already spent), we may deduct
the corresponding value from your account, which may leave a negative
balance, and may suspend the account until it is settled.
Chargebacks or refund abuse may result in account suspension or
closure.
Blue Diamonds granted for free (events, compensation, referrals) are
distinguished in our ledger from purchased diamonds and may be subject
to different rules.
5. Random items
(gacha) and probability disclosure
Some Virtual Items are obtained through random draws: player scouts,
equipment random options, enhancement outcomes and reward boxes.
The probability of each outcome is published in-app on the relevant
screen and at [PROBABILITY DISCLOSURE URL]
(probability-disclosure.md). We update that page whenever a
rate changes.
All random results are generated on our server. The Game includes
guarantee ("pity") counters for scouts as disclosed.
Random results are final. Obtaining a duplicate or an unwanted
result is not grounds for a refund.
6. Online play, fairness
and sanctions
Online matches, rankings, seasons, clan tournaments and the market
are shared systems. We may adjust matchmaking, add CPU opponents, run
maintenance, reset seasons, and correct results affected by bugs or
abuse.
You must not exploit bugs, manipulate matches (win-trading,
collusion, deliberate forfeits to affect standings), abuse referral or
attendance systems, or attempt to manipulate the market.
We may investigate and apply sanctions ranging from a warning to a
temporary suspension or permanent ban,
remove items or currency obtained through violations, and reverse
transactions. Sanctions are recorded on the account and are visible to
you in-game where applicable.
7. User conduct and chat
The Game includes server-wide, language, clan and direct-message
chat, nicknames, club names and clan names. You agree not to:
harass, threaten, abuse or discriminate against others;
post sexual content involving minors, hate speech, or content that
is obscene, violent or illegal;
post or solicit personal information (yours or anyone's) such as
phone numbers, addresses, real names, messenger IDs or government ID
numbers;
post links, advertisements, spam, or solicit real-money
trading;
impersonate other players, staff or the operator;
use a nickname or club name that is offensive, misleading or
infringes rights.
Chat is filtered automatically and moderated by us. We may remove
content, rename nicknames or clubs, mute, suspend or ban accounts
without notice. You can block and report other players in-game. You
retain ownership of what you post but grant us a worldwide, royalty-free
licence to store, display and moderate it within the Game.
8. Termination
You may stop playing at any time and may request account deletion as
described at [ACCOUNT DELETION URL]. Deletion is permanent; remaining
currency and items are forfeited.
We may suspend or terminate your account for breach of these Terms,
fraud, chargebacks, legal requirements, or prolonged inactivity after
notice.
We may discontinue the Game or any feature. If we shut the Game down
we will give at least 30 days' notice in-app and will not sell Blue
Diamonds after the notice. Unused purchased Blue Diamonds will be
handled as required by applicable law.
9. Disclaimers and liability
The Game is provided "as is" and "as available". To the fullest
extent permitted by law we disclaim all warranties, and our total
liability for any claim relating to the Game is limited to the amount
you paid us through Google Play in the 12 months before the claim.
Nothing in these Terms limits liability that cannot be limited by law,
including for fraud, gross negligence, or death or personal injury
caused by negligence, or consumer rights that cannot be waived in your
country.
10. Changes to these Terms
We may update these Terms. Material changes will be announced in-app
at least 7 days before they take effect (30 days for changes that reduce
your rights). Continuing to play after the effective date means you
accept the new Terms.
11. Governing law and
disputes
These Terms are governed by the laws of the Province of Ontario and
the applicable federal laws of Canada, without regard to conflict-of-law
rules, and disputes are subject to the courts of 캐나다
온타리오주(Ontario, Canada). If you are a consumer, you also keep the
protection of the mandatory consumer laws of the country where you live,
and may bring claims in your local courts where the law allows.
